'99 Sebring ATX not downshifting to first gear

Hi,

My girlfriend's '99 Sebring has a problem.  We paid almost $400 to fix a recurring CEL that was ATX related.  I think the guy just programmed it to ignore the problem because he's not smart enough, or wise enough, to know what's really wrong.  Instead of going into 2nd gear limp-home mode when the light goes on, which it did before the reprogram job, it now, when braking to a stop, begins to shift into first, but then shifts abruptly back up to 2nd and takes off in 2nd, too.  At this point, I want to throw it away, but my girlfriend loves her car and since boyfriend is stuck with the bill, she wants to keep it.   I am going to get the dealer to reflash the ECU and see what happens.  If it keeps happening, I'm taking it to a trusted tranny shop that might want to rebuild it.  They already told me they hate these cars, too, which is obviously really bad.  I'm really upset about that possibility of a rebuild.  Does anyone know specific helpful info that I might not since I'm not familiar with these cars?  Supposedly the guy changed the solenoid pack and a relay, but I think his Snapon programming tool I found in the car is how he "fixed" it.  He was stumped for 2 weeks, I call and say regardless I'm coming to get it, go there and it's "fixed" with a programming tool still sitting in the seat.  That's all I know.  Any advice from knowledgeable Mitsu people would be fantastic at this point.  Thanks very much.
